1. Acceptance of Terms

Welcome to GymWin. By accessing or using our mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and GymWin.

2. Description of Service

GymWin is an AI-powered mobile fitness application that provides:

  • Interactive muscle group selection using visual body diagrams
  • AI-generated personalized workout plans based on selected muscle groups
  • Timed interval workout sessions with exercise and rest periods
  • Micro-rewards (tips, jokes, philosophy) delivered after each completed interval
  • Workout progress tracking, statistics, and training history
  • Body visualization with training heat maps
  • Premium subscription features including unlimited workouts and advanced analytics

3. User Accounts and Registration

3.1 Guest Access

You may use GymWin as a guest for up to 2 free workout sessions without creating an account. Guest data is stored locally on your device.

3.2 Account Creation

To access unlimited workouts and premium features, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access or security breach.

4. Subscription and Payments

4.1 Free Trial

New users receive 2 free workout sessions. After completing 2 sessions, continued use requires a premium subscription.

4.2 Premium Subscription

GymWin Premium is available as a monthly ($9.99/month) or annual ($69.99/year) subscription. Premium includes:

  • Unlimited AI-generated workout plans
  • Unlimited workout sessions
  • Advanced analytics and muscle balance insights
  • Premium workout templates
  • Priority support

4.3 7-Day Free Trial

Premium subscriptions include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

4.4 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless canceled. You will be charged through your Apple App Store or Google Play Store account. Prices are subject to change with 30 days' notice.

4.5 Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods, except as required by law or at our discretion.

5. Acceptable Use

You agree to use GymWin only for lawful purposes. You must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to reverse engineer, decompile, or hack the app
  • Use automated systems (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Circumvent subscription or payment mechanisms
  • Upload malicious code or viruses
  • Harass, abuse, or harm other users
  • Use the Service for commercial purposes without authorization

6. Health and Safety Disclaimer

IMPORTANT: Please read this section carefully.

GymWin is a fitness guidance tool and is NOT a substitute for professional medical advice, diagnosis, or treatment. Before starting any exercise program:

  • Consult with a qualified healthcare provider or physician
  • Ensure you are physically capable of performing the exercises
  • Inform your doctor of any pre-existing medical conditions
  • Stop exercising immediately if you experience pain, dizziness, or discomfort

You assume all risks associated with using GymWin and performing exercises. GymWin and its creators are not liable for any injuries, health issues, or damages resulting from your use of the app or following workout plans.

7. AI-Generated Content

GymWin uses artificial intelligence to generate workout plans and micro-rewards (tips, jokes, philosophy). While we strive for accuracy and quality:

  • AI-generated content may contain errors or inaccuracies
  • Workout plans are general guidance and may not suit your specific needs
  • Always use your judgment and consult professionals when needed
  • We do not guarantee the accuracy, completeness, or suitability of AI content

8. Intellectual Property

8.1 Our Rights

All content, features, and functionality of GymWin, including but not limited to text, graphics, logos, icons, images, audio, video, software, and AI-generated content, are owned by GymWin and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Rights

You retain ownership of your personal workout data and progress information. By using GymWin, you grant us a limited license to use this data to provide and improve the Service.

8.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use GymWin for personal, non-commercial purposes in accordance with these Terms.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using GymWin, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

GymWin is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee of Results

We do not guarantee that using GymWin will result in specific fitness outcomes, weight loss, muscle gain, or health improvements. Results vary based on individual factors.

10.3 Limitation of Liability

To the maximum extent permitted by law, GymWin and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your use or inability to use the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless GymWin and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account and access to GymWin at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or abuse of the Service.

You may terminate your account at any time by contacting us or deleting the app. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms will survive termination.

GymWin integrates with third-party services including:

  • Firebase (Google Cloud Platform) for authentication and data storage
  • OpenAI/Anthropic for AI-powered workout planning and content generation
  • Apple App Store and Google Play Store for payment processing
  • Firebase Analytics and Crashlytics for app analytics

These third-party services have their own terms and privacy policies. We are not responsible for their practices or content. Your use of these services is subject to their respective terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of GymWin after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GymWin operates, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of GymWin shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

15.3 Class Action Waiver

You agree to resolve disputes with GymWin on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GymWin regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
